AftrBase Website Terms of Use
Effective date: 22 October 2026 · Last updated: 22 October 2026
These Terms of Use (“Terms”) govern your access to and use of the website available at aftrbase.com and its pages (the “Website”). The Website is operated by AftrBase, with its registered office at 432 B-8, Paryatan Vihar, Vasundhara Enclave, East Delhi, Delhi 110096, India (“AftrBase”, “we”, “us” or “our”).
By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website.
1. Scope of these Terms
1.1 These Terms apply only to the Website, which is a marketing and information website for AftrBase's products and services, including Point of Sale, Smart Receipt, NPS & Surveys, CRM, Analytics, Marketing Automations and Custom Business Apps.
1.2 These Terms do not govern the use of the AftrBase platform or console, including any service made available at platform.aftrbase.com (the “Platform”). The Platform is provided under a separate written agreement or separate terms of service between AftrBase and the business customer. If there is a conflict between these Terms and that agreement in relation to the Platform, that agreement prevails.
2. Eligibility
2.1 The Website is intended for businesses and professionals. By using it, you confirm that you are at least 18 years old and capable of entering into a binding contract under Indian law.
2.2 If you use the Website on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation to these Terms.
3. Acceptable use
You agree not to:
- use the Website for any unlawful purpose or in breach of any applicable law or regulation, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023;
- attempt to gain unauthorised access to the Website, our servers, or any connected systems or networks;
- introduce viruses, malware, or any other harmful or disruptive code;
- scrape, crawl, harvest, or extract data from the Website by automated means without our prior written consent;
- interfere with or overload the Website, or circumvent any security or access control measure;
- submit false, misleading or fraudulent information through any form on the Website;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- copy, reverse engineer, or create derivative works from any part of the Website except as permitted by law; or
- use the Website to build a competing product or service, or to benchmark our products for a competitor.
4. Enquiries, pilots and quotations
4.1 When you submit the “Tell us about your business” or any other contact form, you are asking us to contact you. Submitting a form does not create a contract between you and AftrBase, and does not oblige either of us to enter into one.
4.2 Any pilot, trial, quotation, or paid service will be governed only by a separate written order form, proposal, or agreement signed or accepted by both parties.
4.3 You agree that the information you provide in any form is accurate and complete, and that we may contact you by email, phone, or messaging channels using the details you provide in order to respond to your enquiry.
5. Product and pricing information
5.1 Information on the Website about our products, features, plans, and pricing is provided for general information only. Plan prices shown on the Website are per outlet, exclude GST, and may change; your final pricing is confirmed in your order. Nothing on the Website is a binding offer.
5.2 Some features are described as “coming soon” or are in development, including Marketing Automations and AI win-backs. Descriptions of such features are indicative only. We do not promise that any feature will be released by any particular date, or at all, or that it will be released in the form described.
5.3 Performance figures and statistics shown on the Website (for example, delivery rates, delivery times, open rates, and repeat-purchase uplift) are illustrative. They are based on our own data or specific customer deployments and may vary depending on the customer's business, location, customer base, network conditions, and third-party services. We do not guarantee that you will achieve the same or similar results.
5.4 Screenshots and demonstrations of the console may show sample or illustrative data and may not reflect the current version of the product.
6. Intellectual property
6.1 The Website and all of its content, including text, graphics, logos, icons, images, product screens, designs, software, and the selection and arrangement of them, are owned by or licensed to AftrBase and are protected by Indian and international intellectual property laws. “AftrBase” and associated logos are our trademarks (whether or not registered).
6.2 We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website for your own internal business evaluation of our products. No other right or licence is granted. You must not reproduce, distribute, modify, publicly display, or commercially exploit any part of the Website without our prior written permission.
6.3 Names and logos of third parties (including WhatsApp and any payment, POS, or technology providers) belong to their respective owners. Their appearance on the Website does not imply endorsement or affiliation unless we say so expressly.
7. Feedback
If you send us suggestions, ideas, or feedback about the Website or our products, you grant us a perpetual, worldwide, royalty-free, irrevocable licence to use that feedback for any purpose without obligation to you. This does not apply to personal data, which is handled under our Privacy Policy.
8. Third-party links and services
The Website may link to or embed third-party websites or services (for example, analytics, scheduling, or communication tools). These are not under our control. We are not responsible for their content, availability, security, or privacy practices, and your use of them is at your own risk and subject to their own terms.
9. Disclaimer of warranties
9.1 The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
9.2 We do not warrant that the Website will be free of errors, viruses or other harmful components, or that it will be available at all times. Content on the Website is not legal, tax, financial, or professional advice.
10. Limitation of liability
10.1 To the maximum extent permitted by law, AftrBase and its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Website.
10.2 To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Website will not exceed INR 10,000.
10.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless AftrBase and its directors, officers, employees, and affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.
12. Privacy and data protection
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data through the Website. By using the Website, you acknowledge that you have read it.
13. Suspension and termination
We may restrict, suspend, or terminate your access to the Website at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law, or if needed to protect the Website or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply.
14. Changes to the Website and these Terms
14.1 We may modify, suspend, or discontinue any part of the Website at any time.
14.2 We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Website after the update means you accept the revised Terms. If a change is material, we will take reasonable steps to bring it to your attention.
15. Governing law and dispute resolution
15.1 These Terms are governed by the laws of India, without regard to conflict-of-law principles.
15.2 We encourage you to first contact us to resolve any dispute informally. If the dispute is not resolved within 30 days, it will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration will be New Delhi, India, and the language will be English.
15.3 Subject to the above, the courts at New Delhi, India will have exclusive jurisdiction over any matter arising out of these Terms.
